i listened to the testimony of the cop in this case the other day. I also listened to much of the defense's case in the trial. I was pretty surprised at a lot of the facts that were never made public. This case has been going on in the media for about a year (it seems now) and just came to trial. It has sounded for a year like a no brainer. White cop lady walks into the wrong apartment on the wrong floor and thinks its her apartment, shoots and kills a black guy that lives there thinking he's a burglar. Stupid cop right?
Well, its a bit different story than that. First, she got up at 5 am that morning and worked until close to midnight. She was assigned to help SWAT that day on a pretty dangerous raid/search warrant thing.
anyway, it turns out that her apartment complex has a parking garage, but its all very confusing. Almost everyone that lives there gets off on the wrong floor once a week or so. The problem has something to do with which entrance you use to the garage and how the floors are not numbered. Even some of the cops responding that night to the shooting got off on the wrong floor. And once you are on a floor they all look exactly alike.
And that week the apartments were doing mold checks and had told everyone they would be coming in and out of apartments at odd hours. So this cop lady had taken her dog to her mom's, which was unusual. Her door had a problem with the lock and it was hard to lock. So she remembers every time she leaves the ritual she has to go through to get the door to lock and the deadbolt to catch. this door when she got home (not her door) was unlocked, so she knew immediately there was a problem.
Now, did she need to use deadly force? probably not. I don't know that part and I don't guess anyone will. It was just her and him in the apartment when the gun went off. I'm sure he thought someone was breaking in and was coming with a club or something and she was just as freaked out thinking he had broken in.
